My previous employer is fighting my unemployment claim and now a hearing has been scheduled. What happens at these hearings and who is responsible to provide the burden of proof? Which is that he claims he fired me with cause.

I'm sorry you have to go through this. It must be very unpleasant...

Your former employer should be the one who has to prove his case, but I suggest you come prepared with all the proof you can get to show otherwise. At best there will be no need and his accusations will be refuted, but if need be, it's probably better that you are prepared.
