You can claim him if he doesn't but you also have to count his income

Sure. And the IRS will bust you and you might wind up sharing a cell together. Wouldn't that be some great old fashioned family togetherness? I just have to ask. What is the basis for such a claim? Is the prison sending you a monthly bill? Putting money on his book doesn't qualify as support.
