can a tax preparer be sued for taxes due, interest & penalties because of their error? 2007 tax year, IRS wants $2,100 tax, plus penalties and interest. Preparer says they'll pay penalties and interest. They entered a 5 where they should have entered a 1. They're sorry, but not as sorry as I am.

Look at it this way, had they not made an error, you would have had to pay the taxes in 2007.  Either way, it's your liability.  They are paying the penalties and interest, which is usual for tax preparers,  Usually somewhere on their forms, their policies are stated.

Some can.If it was you mistake you pay all,if it was their mistake you pay prin. they pay interest and penalities
