If you were close to him and have a good relationship, what is to stop you from continuing to have a good relationship? He can always be your son in law if you wish.

I don't know if there are any hard & fast rules governing this type of thing, but if you and he have a good relationship, I say to go ahead and consider him your son-in-law as long as you care to do so.

Your daughter passed away; their marriage didn't end due to divorce. Therefore, he's not an "ex" anything!

Sorry for your loss. Even though your daughter died, he would still be your son-in-law. But, now since he is remarrying, he will no longer be your son-in-law.
