My husband & I are both retired. He receives SS ...

My husband & I are both retired. He receives SS and another pension. I have receive a pension as well. I do not receive SS as I did not work long enough ( less than 40 quarters) to receive benifits. If my husband should die before me, am I elgible to receive SS based on his benifits? Hazel

Hazel,  As long as you have been married to you husband for at least 10 years, you can collect on his social security benefits.

Good afternoon Hazel - Yes is the short answer as long as you are not planning on killing him. See the Social Securiy Handbook at this link -- http://www.ssa.gov/OP_Home/handbook/handbook.04/handbook-0401.html . You didn't say who your pension is from. The one cavat would be if you are retired from the US Government and your pension is more then 2/3 your husbands (called an 'Offset"), then you would continue drawing yours. If his (pension) is bigger then yours however - you get his. Hess
