Well according to The Prowler at http://spectator.org/archives/2010/07/16/with-liberty-and-global-justic their are two persons who it could have came from ,one being Sir William Blackstone, an 18th century jouunalis who wrothe the Commentaries on the Laws of England.  then some other Lawyers claim it came from C. Wilfred Jenks a leader in international law from the '30's
