The Planned Community act is applicable only to communities created after 1999. Additionally, the law does not apply to communities of less than 20 residential lots, or not zoned for residential use. All records pertaining to the residential community must be registered in the county where the neighborhood is located. In order to establish the community, one need only register the community declaration within the county. In general the act outlines provisions by which such a community must be managed, developed, or terminated, and also protects the home owners association from lawsuits pertaining to amendments after one year has passed from the establishing of the amendment.
