All states have committees that convene annually to consider "sentencing guidelines" for given offenses.  Judges may not wish to maintain those guidelines but they do so to avoid appeals for "cruel and unusual" punishment.

That is why Judges may convene postconviction hearings to consider appropriate sentencing if the case warrants. 

Usually the Judge sets the sentence according to State guidelines.
