My brother died after having heart surgery. He did not die on the table, he died in his room after the surgery. The nurse on duty had a lot of other patients to take care of and could not give this fresh out of heart surgery person much attention because of the other patients. He died. They said his monitor wasn't working, and he was allowed to inject hisself with pain medication. He was losing air and his heart stopped. They opened him back up to try save him but couldn't. Do you think the hospital bares any responsibility.

Yes, absolutely.  It sounds like he died because they weren't doing their job and paying close enough attention.  You should have a very good lawsuit for this.

Not necessarily. it depends on his condition, age, risk factors prior to surgery, and the risks involved in the surgery. Sometimes surgery is too risky and not the correct decision but a patient, or their family is deperate for anything to "save" them and surgeons want to cut. Not everyone can survive major surgery.

I have been in this situation - and everyone knows you cannot count on any nursing care at all in a hospital setting anymore. You must read everything you can abiut the surgery, ask questions about the aftercare, what to expect immediately after and then someone needs to be with the patient AT ALL TIMES TO ACT FOR THEM WHEN THE NURSES CAN'T OR WON'T. If they need pain meds, stay on it until you get it for them-aggravate them enough until they help you, call the dr's office yourself and tell them what is going on. YOU HAVE TO DO THIS! The nurses are woefully understaffed and don't have any real power because most are just LPNs or lower. You must be the patient advocate for your mom, sister, brother-in the hospital, 24/7. Even, especially at night. You do have the right to be there.

But do you have a lawsuit? Only if you can find an attorney to take your case and only then if he thinks he can prove real neglect, not a sudden turn for the worse, after major, risky surgery. My condolences on your loss.
