I did this on Monday. If you are needing to fire an attorney you already have representing you then you send them a letter basically firing them (stating you are no longer in need of their services) and then you are free to search for new representation.

In most cases, the Court requires specific paperwork be completed and filed before it will consider you as no longer being represented by your current attorney.

The name of the form may vary from state to state, but your attorney should know what is needed.

As such, notify your attorney that you no longer wish him or her to represent you. If you have retained a new attorney, provide that attorney's information to your existing attorney (it will be needed on the form).

(If you intend to represent yourself, then let your attorney know that.)

Your attorney will then prepare the necessary form (Notice of Substitution) for the appropriate signatures. Once the form has been signed and filed with the Court, you can proceed to represent yourself (or your new attorney may act on your behalf).

Note: Be sure you ask for and receive a court-filed copy of the document. If it is executed, but not filed with Court, nothing will change as far as the Court is concerned.

Formally let them know that you no longer need their services. I hope that you had better luck with your new trial lawyer . Make sure your new lawyer will help you sort out all these details.
