You have to check the specific state codes but here is the general definition:

Kidnapping Law & Legal Definition

Related to Kidnapping

Kidnapping is generally defined as the abduction of another person with intent to:

  1. Hold him for ransom or reward; or
  2. Use him as a shield or hostage; or
  3. Accomplish or aid the commission of any felony or flight therefrom; or
  4. Inflict physical injury upon him, or to violate or abuse him sexually; or
  5. Terrorize him or a third person; or
  6. Interfere with the performance of any governmental or political function.

Abduction may be made by secreting or holding a person in a place where he is not likely to be found, or using or threatening to use deadly physical force. Unlawful imprisonment is similar to kidnapping, but involves the restraint of movement of a person, as opposed to an abduction. Laws vary by state, so please consult the law in your area to determine applicable requirements.

Here is a link to a very informational site regarding the laws surrounding kidnapping, and what constitutes the charge of kidnapping. I hope it has the answers that you are looking for.

Maya, you're welcome.  I hope this isn't a personal problem.

PB, it is a personal problem. "This is day 3 since the horror show". I am gathering info before I do anything and letting the dust settle some as there was a huge dust storm in my town on Saturday. The day started out great and everything was status quo until my son-in-law pulled a nutty. I did speak to a friend last night who is retired from police force and he said that it was ridiculous and the threat made to me was nothing but an "idol threat". I plan to go higher up on reporting this so I need to have it all together.

Maya, yeah, you better cover all the bases and have a police report already filed before anything else happens.   It will make things go quicker should something happen, God forbid.

PB, It got real ugly. They (police) were a real treat to deal with. If you click on my profile you will see some other questions I asked recently (if you want to). I am beside myself. I am lost. I am crying right now. I don't know what to do. I have not been allowed to see my grandchildren since that day. (This past Saturday.) They are my life. I miss them. I know it sounds wierd that it has only been 3 days but I always see them as a regular part of my life. My daughter wants to keep the marriage working (not that it is) she wants to keep the family together. My mother called me and told me there will be an investigation due to need of investigating abuse. He rammed into me too body slam style during his fit of rage. They told me If I file a report they will get me for kidnapping so they more or less put even more fear into me and left me like this. I am at least glad they are investigating. I don't care what my daughter thinks anymore. She is blind where I can see. Her husband is from a family where there was ALOT of abuse to the point he ended up in foster care.
