I e-filed taxes on 01/16/09 and 3 days later found out needed to file form 8379, injured spouse, to combat the offset from my new husbands back child support. First the IRS couldnt verify I am who I say I am because they dont frequently communicate with the social security people...they finally did and my return was processed on 02/11/09. Here is where I get lost. I sent the injured spouse form in to the field office for my part of the country and they received it 01/23/09 (I tracked it to make sure). Now I receive message on "Where's my refund" that refund should be deposited by 02/13/09 but at a different amount due to blah, blah, blah... IRS website says it takes up to an additional 8-12 weeks depending on how you filed so is there more work to be done or can they possibly have sped through and gotten it done in record time??? If not how long does it REALLY take?
when i worked with irs some years ago injured spouse claims took 8 to 12 weeks after filing to obtain results. e filing in a case of injured spouse only helps get it there a few days earlier than mail,,,otherwise no difference....any money coming to you will be mailed to you within that timeframe. if you havent received your refund by 8 weeks after filing call taxpayer service at 18008291040. be sure you have your return copy in hand when you call.
I have also mailed an injured spouse form after e-filing joint wages with my husband. I found out he owes a student loan from 3yrs ago before we were married. I contacted the IRS they have stated they received my form 20 days ago and are reviewing it. They told me it can take up to 14weeks to get a decision and check in the mail if their decision goes to my favor. Hang in there given the fact your information was accurate on the form you should be given back your due moneys. You better call and ask them if they actually processed your form. I turned my form in with my taxes and they said they never got it. I've waited two months already and now I'll have to wait an additional 8 weeks processing time for the new form I mailed today.
