hello, this is a case that people go through alot of times.Some times it is the roommate and other times it is a boy/girl friend.Or sometimes just a person that you was trying to help out.Well i know at some point in every one life they will have this question to answer.BUt the only thing that you can do at this point is give them 30 days notice that you want them to move out.You can't just put them out cause the police are going to say if they have leaved or stayed there longer than 30 days they are like a tenant.That means you have to let them stay and you can't get any money at this time.If you feel that you should be given money cause they did stay there you have to take them to court.YOu must also have a written or verbal statement saying that they admitedto paying.If you have never had a statement saying what the rules and amout was you might lose your case.So please prepare yourself with all the things that you will need to get them out of your house.Another way you can do this is to get a lease statement from landlord saying that the rent will be going up cause you hae someone esle living there.This can really happen if the landlord finds out that you have let some one live with you with out the premission from the landlord.This can also have the landlord to put you out cause you never told or ask the landlord.Well if i was you i would try to do what it takes without getting yourself into trouble.Well i hope that every thing you do comes out right for you and your roomate.Well what happen to you and your roomate that now you want them gone?

it doesn't matter if the person is added to your lease (which you broke the law by subletting the room without the knowledge of the lessor) if you acknowledge the person as a roommate you must file a unlawful detainer and evict the person legally.
