What happens if marital agreement papers are ...

What happens if marital agreement papers are signed during a divorce stating that both parties have to draw up new wills leaving their properties to each other upon death and the new wills were never drawn up and one of the parties passes away?

Well if you have legal documentation agreed upon and signed by a judge... I would say call an attorney and ask... I would think you could contest the will in place... since there is an order that was signed during the divorce... but the only way that will happen is by hiring an attorney... sounds like it should be a fairly easy case...
