Hi, I'm supposed to go to my first court date for an OWI, worst and most reckless decision I have ever made, and my attorney told me that he can represent me in court and I do not need to be there. Is this allowed? He's handled many of these cases before, but what if he gets held up and can't make it? Its a long drive and I'm supposed to be at my classes that day.

OWI? do you mean DWI? Regardless... my brother had this same scenerio about 3 yrs ago... he had his own attorney... he had been working out of town... his attorney assured him he could take care of it without him... after a few mo... my bro called his attorney since he had not heard from him... he paid and the attorney told him he was working w DA... attorney said he would contact him when it was over... since my bro had paid him and never heard anymore he assumed it was dismissed or thrown out... 2 yrs later got pulled over out of town... and there was a warrent fro his arrest... failure to appear... had to hire another attorney... eventually everything worked out fine but what a headache... better to be safe than sorry... I'd go in person... Good Luck:)

    Gemini is right, gave her 2 thumbs up.  I don't have anything against lawyers except that they are very fast in asking for money but too slow to do what they are hired for.  So just go to court on the hearing day.

Be honest and be true to yourself.

I've had two.  Major mistakes on my part.  I've never heard of not needing to be present.  You need to check with the court or call another lawyer.  It doesn't cost to ask questions.  Depending on you BAC, your lawyer may work a deal with DA, but, he should tell you that.  Also, never heard of an OWI.  DUI or DWI, but no OWI>  ???  Typo?
