What should I do, am Back in a Coner

My husband was the household carrier for 7 yrs, until  Nov. 2008, he lost his job and became ill and now is unable to work. Now I have to provide for the family, since Nov. of 08, we lost our house, got a apartment, lost one car and now is in debt with credit card, pass do bills, my business in going under, my hours got cut at work, about to loose my car our only means of transportation, try to refinance the car, and get a loan, credit  score to low, only make enoght to maintain home and take care of kids, should I apply for bankrupts, to get the  car lost and credit card company off my back for now? and try to sale the business to make until something else comes around?

I am a retired Insurance agent. The first thing you should do is apply to the State for your husband. If your husband is totally disabled and cannot work you can apply for SSI through the state and Inhome care assistance. With inhome care you can get paid through the state as his Caregiver. Between SSi and Inhome care you can have income and be at home. The third thing is If your husband has been disabled for 25 months or more he can apply for his social security security. What's nice about all three programs I just gave you is you will get help for his medications and medical care, no insurance premiums to worry about.

I agree with rjazzdoc that you should be able to receive assistance for your husband. I also work in the financial industry and bankruptcy might be an option for you, but it doesn't always let you off the hook. You need to, as we say in the buisness, run the numbers. Go talk to several different agencies and get information so you can know what your options are.  You might want to liquidate your buisness if it is not makeing your significant money.  Is it breaking even?  Could you be making more at a job?  Do you have a skill you could make and sell things from home or flee markets? Are your children old enough to work or babysit to make their own money?  I hope the best for you and your family.  I will say an extra prayer for you.

I am so sorry for your situation. I also agree with rjazzdoc. Sometimes it's okay to ask for help! Would I recommend abusing these benifits? Absolutely not. You might check and see the pros and cons of selling your business, and remember that it's always an option. I know that with the economy how it is right now, it's hard for small business owners! You'll be in my prayers!

Number one I would seperate your self from your husband. Secondly if you

put all of your bills together, add them up, and see what that is, Then I would call

the bill collectors, and see waht you can work out..Remember they want their money but they are realistic..good luck

My suggestion is do not believe those financial consualtant. The most important thing is to earn money. Do not rely on any debt and loan. I suggest you can import some thing from chinese. Those products is very competition. Regarding to what kind of business is suitable for you, that will depend on the relations you have. But I think most things will be ok for American market. First of all , the answer that rjazzdoc gave is a good start , but you need to get with a BK Atty and see if a chp 13 or whatever it is in the state u live , in Ohio that's a reorganization , debpter in possestion and this stops the Wolves from biting you and gives you a chance to evaluate your best moves . Rjazzdocs answer is good to the point of helping your husband with medical asst , some income while you get with an atty that can review your income and expences and develope a plan that allows you to keep control of your business and personal life . PS I TRIED TO KEEP This short but you needed information not bits or peices .

You need to develop an action plan, prioritize the list and work on the most important things first.  Purchase or read Susie Orman's 2009 book (QVC sells it).

Don't blame your husband for becoming ill (nothing good can be accomplished by doing that).  Most people provide for their family and partners help each other out, don't they?

Having been a paralegal in a law practice that was 90% a debt collections practice, I can tell you a few thing I learned in the last 30 years as a paralegal.
If ANY collector abuses you on the phone or threatens you do not accept that attitude.

  • The bill collectors must comply with the Fair Debts Collection Practices Act

  • POLITLY ask for the collector’s supervisor.

  • Tell the supervisor you are aware of the Fair Debts Collection Practices Act and would like the debtor to understand your situation.
  • Ask them to suggest how their demand can be reduced to accommodate all the debts you owe.

Try to negotiate a settlement

Tell the collector;

  • there is only one pie and they can not have it all.

  • Those who want a small piece of the pie will get something.

  • Those who want the impossible will get nothing until such time at those creditors who accepted a little at a time are satisfied.

  • The greedy gets paid at the end of the line.

 

NEVER SAY YOU ARE REFUSING TO PAY

Tell the creditors,

  • "I am not dishonest, please do not treat me as if I do not want to pay you back.. I do want to pay you back."

  • Those creditors who offer a DISCOUNTED one lump sum settlement may be paid if I can borrow the money from other sources. Those who are unwilling to compromise may wait a long time. I can not guarantee I can borrow the money but will try if your discounted offer to settle is exceptional.

  • Bankruptcy is my LAST option but it is an option..
  • The attitude you have in resolving this issue will determine who gets paid first and who gets paid possibly nothing as ganging up on me may force me to bankruptcy relief.

Collectors and creditors will respond to the above.

Buy a phone recording machine from Best Buy or Radio Shack or someone like that. RECORD ALL CALLS.

If they get angry and yell at you take the recording to an attorney and your money problems will be over and the Fair Debt Collections Practices Act levies heavy penalties for yelling and unbusinesslike conduct.

You can have everything in life your want if you will just help enough other people get what they want
