A notice given by defendant to a plaintiff that he appears in the action in person or by attorney.

Thank you tennisguy, Sorry but I still do not understand! My ex husband and I have share custody of our daughter and we came to the agreement that he is going to give written authorization to be move out of the state with her. I have asked my lawyer to make a document stating it to make it legal, and he aid that he had to file a notice of appearance in order to do that. does this mean we have to go to court? (we wanted to avoid doing that) Is the father of my child going to receive any papers from the court? Thanks, Patty

This type of thing has to be done through the court, which assures that your husband receive legal notice of your desire for an agreement.  The court would wish to approve of the agreement.

A "notice of appearance" is a document given to the court to notify them that the attorney is coming onto the case or filing a case and representing you. If you file a notice of appearance, then you are saying that you represent yourself when you file your case. The notice of appearance is filed at the same time that the case is first filed with the court. Your case would be simply a request for the court to approve any written agreement between you and your husband regarding your child. You either pay the attorney for his work, or you go to a legal aid office (court clerks can give you a list) and ask them to do the legal work through charity.

To appear in front of the Judge or go hire an Attorney and speak to them about it, it sounds like you need some council on this.

enetering his appearance to the court..........for instance his attorney will submit his paperwork and enter in appearance as attorney for record .....basically that he is filing a motion and he came their or will be there at court when time comes in easy terms
