It would behoove your boyfriend to make his wishes known via specific legal documents such as a standard Will, Living Will and/or a simple Trust.

Otherwise, I believe the law will take into account the wishes of his next of kin - which would be his children, not you. No matter how many years the two of you have been together.

You may want to check your state law, but Texas, being a common-law state, has common-law laws to support the spouse, but of course, it has to be viable, such as filing taxes together, presenting yourselves as husband and wife, and whether you carry his last name.

Of course, you and he could get something in writing, which is the most legal way to go and be assured that each other's plans are carried out.
