What is the difference between statutory and non statutory regulations

Statutory means that they have been set in law

Non-statutory regulations are usually done by a professional governing body and not directly through legislation.

 

This does not mean that non-statutory do not have legal standing.  Usually a professional governing body makes non-statutory regulations to their profession based on or in elaboration to statutory regulations.  The courts, especially civil, will evaluate if there is misconduct based on the non-statutory, and many insurance companies, and self-regulating bodies will not allow individuals to practice a profession if they do not adhere to the regs.
