You need to contact a bankruptcy attorney but if you decide you would like to have your mortgage loan modified before the bankruptcy, you may qualify due to your hardship. You should do this before you file because the credit card debt will contribute to qualifying you. Once the mortgage has been modified, you can file bankruptcy and "reaffirm" your mortgage to keep the house out of the bankruptcy. You are allowed to do this in order to keep your car, home or any other debt that you would like to continue to pay.

Not necessarily, but I think the answer would depend on the severity of your injuries and the quality of life you are able to live due to those injuries. In many cases, the bankruptcy court will seize a settlement (from an accident or other lawsuit) and use it to pay parts of your debt before giving you a discharge. Contact a Minnesota bankruptcy attorney (or a bankruptcy attorney in your own state), and ask for help. You need a lawyer on your side, in this instance, to help you protect yourself and your minimal assets.
