"Several factors account for the dearth of minorities at the court: continuing problems in recruiting and retaining blacks and other minorities at the top law firms; the rise of a small group of lawyers who focus on Supreme Court cases; the decline in civil rights cases that make it to the high court; and the court's dwindling caseload."

If you look at the age of many people in the supreme count, you'll see that they are mostly older than 50 years old.  I know this may seem like a cop-out answer, but it really does matter.  People who are this age and black didn't have the same opportunities that young black people do today.  A black person can become President of the United States today... that wasn't something in anyone's mind even 30 years ago.  I think that it will take time for this generation of Harvard and Yale Law School graduates to make their way into the supreme court.  Don't worry though, it will happen :)

It's not the mountain we conquer... but ourselves

If you have to present your case to the supreme court that means you have presented your case to all the lower courts at every level and you havent been succesful.  So your last hope is to have the supreme court agree to hear your case because your clients constitutional rights have been violated by the lower courts. So maybe the appearance of black lawyers is rare because they are so well qualified in their field that their cases are won the first time.  This means their client is happy and the opposing party has no reason to appeal.
